Here\u2019s a look at <\/span><a href=\"https:\/\/www.facebook.com\/CambridgeHouseApts\/\"><span style=\"font-weight: 400;\">one apartment complex\u2019s Facebook page,<\/span><\/a>\u00a0<span style=\"font-weight: 400;\">which may or may not be the place I lived for two-years during college. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Creating these social media accounts is a great way to stay connected with your residents, promote events, encourage community bonding, and market your rental properties. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">While using social media is a great way to connect with your current and future tenants, you need to remember that, as an extension of your company, your social media pages must comply with all <a href=\"https:\/\/www.rentecdirect.com\/blog\/10-landlord-tenant-laws-to-remember\/\">landlord-tenant laws<\/a>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the most important housing laws landlords and managers need to remember when using social media for your rental business, is to comply with <\/span><a href=\"https:\/\/www.rentecdirect.com\/blog\/fair-housing-act\/\"><span style=\"font-weight: 400;\">Federal Fair Housing Laws<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means that anytime you talk about your property, whether on the property\u2019s page or your personal social media account, you need to avoid discriminating against a protected class. <\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Federal Fair Housing Laws<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.rentecdirect.com\/blog\/fair-housing-act\/\"><span style=\"font-weight: 400;\">Federal Fair Housing Ac<\/span><\/a><span style=\"font-weight: 400;\">t prohibits housing providers from discriminating against a protect class. By using the language \u201cperfect for families\u201d you are essentially saying that the property is better suited for a renter based on their familial status which is a protected class. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Any rental ad, or social media post, must comply with federal fair housing laws. <\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Unintentional or Accidental Discrimination<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Even if you have no intention of preferring one renter over the other, you can still get accused of housing discrimination. Unintentional discrimination is referred to as disparate impact. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Back in 2015,<\/span><a href=\"https:\/\/www.rentecdirect.com\/blog\/are-you-breaking-fair-housing-laws-unintentionally\/\"><span style=\"font-weight: 400;\"> the Supreme Court provided further clarification<\/span><\/a><span style=\"font-weight: 400;\"> on anti-discrimination laws regarding disparate impact for the Fair Housing Act.<\/span><span style=\"font-weight: 400;\"> \u00a0<\/span><a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2015\/06\/25\/417433460\/in-fair-housing-act-case-supreme-court-backs-disparate-impact-claims\"><span style=\"font-weight: 400;\">The June 2015 ruling, saw a 5-4 decision<\/span><\/a><span style=\"font-weight: 400;\"> that an action can be considered discriminatory even if the <\/span><i><span style=\"font-weight: 400;\">intent <\/span><\/i><span style=\"font-weight: 400;\">was not.<\/span><\/p>\n<h2>Fair Housing and Social Media<\/h2>\n<p><span style=\"font-weight: 400;\">In order to help you stay compliant with Federal Fair Housing Laws on your social media accounts, <a href=\"http:\/\/gracehill.com\/blog\/social-media-compliance-fair-housing-laws\/\">Grace Hill<\/a> provides the following guidance:<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/gracehill.com\/about\/\"><b>5 Tips to Ensure Social Media Complies with Fair Housing Laws<\/b><\/a><\/p>\n<p><b>Train everyone in fair housing.<\/b> <span style=\"font-weight: 400;\">Before being given access to your social media accounts, each person should complete fair housing training and acknowledge your company\u2019s policies and procedures. Do the same for any agency or service that has access to your social media.<\/span><\/p>\n<p><b>Show diversity in images<\/b><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">Consider all federal, state, and locally protected classes. For example, show males and females, people of different races, people with disabilities, a variety of ages, and families with and without children. Show diversity when using avatars, animated characters, and illustrations, too.<\/span><\/p>\n<p><b>Use welcoming language. <\/b><span style=\"font-weight: 400;\">Social media messages must not position your community as more or less suitable for someone based on membership in a protected class. Avoid things like racial or ethnic terms, references to religion, exclusions based on disability, and limitations based on familial status. A good rule of thumb is to describe the community, not the people.<\/span><\/p>\n<p><b>Designate a point person to regularly review all social media posts.<\/b><span style=\"font-weight: 400;\"> Reviews should look for words or images that discriminate, limit or deny equal access to your community based on membership in any federally, state or locally protected class.
