Then, in December of 2016, the Seattle city council voted \u00a0<\/span><span style=\"font-weight: 400;\">to pass new proposal that will cap the move-in money landlords are allowed to charge and give renters the right to pay their move-in costs in installments.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">About the First Come, First Serve Rental\u00a0Law<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A landlord will have to disclose information regarding their <\/span><a href=\"https:\/\/www.rentecdirect.com\/blog\/2015\/10\/how-to-create-written-screening-criteria\/\"><span style=\"font-weight: 400;\">minimum screening criteria<\/span><\/a><span style=\"font-weight: 400;\"> before accepting rental applications.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The landlord will have to screen applicants in the order in which the applications were received, \u00a0in person, electronically or through the mail, and make offers to qualified applicants in that order.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Landlords will be required to keep records of when applications were received. Renters can then request those records from the Seattle Office of Civil Rights. If applicants think they were wrongfully skipped, they will be able to sue the landlord.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The first-come, first-served policy technically took effect Jan. 1 but the council <\/span><a href=\"https:\/\/seattle.legistar.com\/LegislationDetail.aspx?ID=2905979&amp;GUID=665BE0B3-D4E4-4926-BD3B-A16054DC19A1&amp;FullText=1\"><span style=\"font-weight: 400;\">passed a bill in December<\/span><\/a><span style=\"font-weight: 400;\"> setting a compliance deadline for landlords of July 1 and <\/span><a href=\"http:\/\/www.seattletimes.com\/seattle-news\/politics\/seattles-first-come-first-served-policy-for-renters-may-be-delayed\/\"><span style=\"font-weight: 400;\">postponing enforcement<\/span><\/a><span style=\"font-weight: 400;\"> until then.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">About the Seattle Landlord Lawsuit against First Come, First Serve<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In a lawsuit that was filed in King County, <\/span><span style=\"font-weight: 400;\">landlords say the first come, first serve policy \u2014 believed to be the first of its kind in the nation \u2014 violates their right to rent property in a nondiscriminatory manner to the people they choose at the price they choose.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The following information is according to <\/span><a href=\"http:\/\/www.seattletimes.com\/seattle-news\/politics\/seattle-landlords-sue-challenge-citys-first-come-first-served-rental-law\/\"><span style=\"font-weight: 400;\">Daniel Beekman for Seattle Times:<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.documentcloud.org\/documents\/3514315-FirstInTimeComplaint.html\"><span style=\"font-weight: 400;\">King County Superior Court lawsuit<\/span><\/a><span style=\"font-weight: 400;\">, filed on March 9, 2017 says the policy violates the state constitution and seeks a permanent injunction to bar the city from enforcing it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the <\/span><i><span style=\"font-weight: 400;\">Seattle Times<\/span><\/i><span style=\"font-weight: 400;\">, The Rental Housing Association of Washington says it advises landlords across the state to choose renters on a first-come, first-served basis \u2014 to avoid discrimination claims. But the association has called Seattle\u2019s policy burdensome and poorly written.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The lawsuit says the city\u2019s policy amounts to an unconstitutional taking of private property and violates due-process and free-speech protections.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Seattle Times article has over 241 comments from readers expressing support or disagreement for the lawsuit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Supporters argue in favor of a landlord protecting his rights to use tenant screening to assess risk and protect his investment. They additionally argue that the first come, first serve law will negatively impact the rental housing market, by making tenant screening criteria extremely competitive. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Those who argue against the lawsuit and in favor of the new rental law, support the idea that landlords need government regulations to prevent discrimination and provide fair housing.<\/span><br \/>\n<em><strong>What do you think about the new rental laws in Seattle?
