{"id":6587,"date":"2017-02-06T12:32:10","date_gmt":"2017-02-06T20:32:10","guid":{"rendered":"https:\/\/www.rentecdirect.com\/blog\/?p=6587"},"modified":"2017-02-06T12:49:21","modified_gmt":"2017-02-06T20:49:21","slug":"portland-landlords-must-pay-renters-moving-fees","status":"publish","type":"post","link":"https:\/\/www.rentecdirect.com\/blog\/portland-landlords-must-pay-renters-moving-fees\/","title":{"rendered":"Oregon Landlords Must Pay Renters&#8217; Moving Fees"},"content":{"rendered":"<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-6598 size-full\" src=\"https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2017\/02\/Landlords-Forced-to-Pay.png\" alt=\"Portland Moving Fees Law\" width=\"560\" height=\"315\" srcset=\"https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2017\/02\/Landlords-Forced-to-Pay.png 560w, https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2017\/02\/Landlords-Forced-to-Pay-300x169.png 300w, https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2017\/02\/Landlords-Forced-to-Pay-352x198.png 352w\" sizes=\"(max-width: 560px) 100vw, 560px\" \/>Portland, OR is making headlines for another pro-renter policy that is going to cost landlords thousands of dollars. <\/span><\/p>\n<p>How many thousands?<\/p>\n<p><strong>$2,900 &#8211; $4,500, depending on the type of house a landlord owns.<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The latest city ordinance will <\/span><a href=\"http:\/\/www.opb.org\/news\/article\/portland-passes-emergency-bill-requiring-payments-to-tenants-for-no-cause-evictions\/\"><span style=\"font-weight: 400;\">require Portland landlords to pay their tenants a relocation<\/span><\/a><span style=\"font-weight: 400;\"> fee for a no cause eviction or if rent was raised by more than 10 percent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The proposal was issued by City Commissioner Chloe Eudaly and Mayor Ted Wheeler will require landlords to pay moving costs for tenants who face a no-cause eviction or a rent increase of more than 10 percent in a 12-month period.<\/span><span style=\"font-weight: 400;\">\u00a0\u00a0<\/span><\/p>\n<p>In the past year, Portland has introduced several rental laws intended to protect renters, like the unprecedented <a href=\"https:\/\/www.rentecdirect.com\/blog\/rent-increases\/\">90-day notice for rent increases<\/a> introduced last year. \u00a0These laws are in response to low vacancy and rising rent prices. While some people are quick to blame the greedy landlord for a spike in rent prices, it&#8217;s important to consider the natural upturn in market rate when demand increases to meet the growing population. According to \u00a0U.S. Census data, the city gained \u00a0more than 12,000 new residents between July 2014 and July 2015, making it the 26th largest city in the country.<\/p>\n<h3><span style=\"font-weight: 400;\">What is a no-cause eviction? <\/span><\/h3>\n<p>A no-cause eviction is a notice a landlord sends a tenant asking the renter to move out on a certain date. A landlord must follow their state and local laws about how much notice they are required to give renters before they must move, typically between 30-90 days.<\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.osbar.org\/public\/legalinfo\/1253_ResidentialEvictionNotices.htm\"><span style=\"font-weight: 400;\">Oregon State Bar website explains no-cause evictions<\/span><\/a><span style=\"font-weight: 400;\"> as:<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">To end a month-to-month tenancy, you or your landlord must give each other written notice. This notice can be given at any time, but it must allow for at least 30 days before the actual date of termination. In the city of Portland, tenants are entitled to 90 days notice of a no-cause eviction. If your tenancy began more than one year ago, your landlord must give you a 60-day notice of termination \u2014 except in the city of Portland, where 90 days are required. The notice must clearly state the date that the tenancy will end. In private rental housing, it is not necessary for either party to give a reason for ending the tenancy, although a landlord may not give such a notice for an illegal reason. A landlord may base a court eviction proceeding on a 30-day notice given by a tenant.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">It\u2019s important for renters to understand that a no-cause eviction is not technically an eviction. It will not show up on your record as an eviction, like a traditional eviction for non-payment of rent might. An official eviction is a lawsuit that is filed against a tenant. \u00a0A no-cause eviction is the same as a no-cause notice to move. If a renter does not vacate the property on the date specified in a no-cause eviction notice, a landlord can move forward with filing an eviction with the court. \u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.rentecdirect.com\/blog\/legal-eviction\/\"><span style=\"font-weight: 400;\">Learn more about What is a Legal Eviction Process?<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">One of the reasons a landlord may issue a no-cause eviction is to find a new tenant that meets these <\/span><a href=\"https:\/\/www.rentecdirect.com\/blog\/10-qualities-of-a-dream-tenant\/\"><span style=\"font-weight: 400;\">dream renter qualities<\/span><\/a><span style=\"font-weight: 400;\"> (like keeping up with renter required maintenance or communicating effectively), to do major property maintenance or renovations, or to find a new tenant that can afford a higher rental rate.<\/span><\/p>\n<p>Rachel Monahan, a housing writer for Willamette Week, compares the new Portland ordinance to one in Seattle where <a href=\"http:\/\/www.wweek.com\/news\/city\/2017\/01\/24\/city-council-releases-plan-to-make-portland-landlords-pay-moving-costs-for-renters-they-evict-for-no-cause\/\">low-income tenants may qualify for moving assistance<\/a> after receiving a no cause eviction, but this a flat amount of $3,490 that is paid by the city.<\/p>\n<h3>How much will a landlord have to pay?<\/h3>\n<p><span style=\"font-weight: 400;\">Under the new city ordinance, t<\/span><span style=\"font-weight: 400;\">he amount of relocation assistance a landlord would be required to pay their renter if they choose to move after receive a rent increase notice above 10 percent is based on property size. <\/span><span style=\"font-weight: 400;\">Those renting studios would receive $2,900, one-bedroom renters would get $3,300, \u00a0$4,200 for two-bedroom occupants and those renting a unit with three or more bedrooms would receive $4,500, according to <\/span><i><span style=\"font-weight: 400;\">T<\/span><\/i><a href=\"http:\/\/www.oregonlive.com\/opinion\/index.ssf\/2017\/01\/renters_relocation_assistance.html\"><i><span style=\"font-weight: 400;\">he Oregonian<\/span><\/i><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>The relocation requirement would apply only during Portland&#8217;s housing emergency, set to last through October 2017.
