{"id":3676,"date":"2018-05-16T09:51:00","date_gmt":"2018-05-16T16:51:00","guid":{"rendered":"https:\/\/www.rentecdirect.com\/blog\/?p=3676"},"modified":"2023-05-15T11:47:47","modified_gmt":"2023-05-15T18:47:47","slug":"how-to-raise-the-rent-on-your-tenants","status":"publish","type":"post","link":"https:\/\/www.rentecdirect.com\/blog\/how-to-raise-the-rent-on-your-tenants\/","title":{"rendered":"How to Raise the Rent on Your Tenants"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-9297 size-large\" src=\"https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2015\/08\/How-to-Raise-the-Rent-on-Your-Tenants-600x343.png\" alt=\"rent increase\" width=\"600\" height=\"343\" srcset=\"https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2015\/08\/How-to-Raise-the-Rent-on-Your-Tenants-600x343.png 600w, https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2015\/08\/How-to-Raise-the-Rent-on-Your-Tenants-300x171.png 300w, https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2015\/08\/How-to-Raise-the-Rent-on-Your-Tenants-610x349.png 610w, https:\/\/www.rentecdirect.com\/blog\/wp-content\/uploads\/2015\/08\/How-to-Raise-the-Rent-on-Your-Tenants.png 700w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/p>\n<p>Increasing the monthly rent on your rental properties is something every landlord will inevitably experience. \u00a0Like most industries, the rental market responds to economic trends creating opportunities for owners to ask more or less for rent depending on their region. \u00a0The recent years have provided a positive position for rental property owners who are experiencing <a href=\"https:\/\/www.zillow.com\/rental-manager\/market-trends\/\">rising rental rates across the nation<\/a>.<\/p>\n<p>Landlords may decide to increase their <a href=\"https:\/\/www.apartmentlist.com\/research\/national-rent-data\">rental prices in order to match market rates<\/a>, to pay for property maintenance or improvements, to accommodate tax increases, or simply to increase their profits. \u00a0The trick to raising rents appropriately is doing so in a manner that <a href=\"https:\/\/www.rentecdirect.com\/blog\/2015\/05\/the-real-cost-of-tenant-turnover\/\">limits turnover <\/a>and keeps vacancy rates low.<\/p>\n<p>In most cases, states regulations dictate when a landlord can legally increase rent prices and how the increase must be communicated to current tenants.<\/p>\n<h3>When To Increase Rent<\/h3>\n<p><a href=\"http:\/\/www.nolo.com\/legal-encyclopedia\/free-books\/renters-rights-book\/chapter3-8.html\">Landlords are legally allowed to increase their asking rent prices<\/a> in-between lease terms or under a month-to-month rental agreement, as long as proper notice is given.<\/p>\n<p>You do not have the right to increase rent prices in the middle of a lease term unless your lease agreement specifically states when and how much rent will increase during tenancy.<\/p>\n<h3>How To Inform Your Tenants<\/h3>\n<p>Most states require official notices of rent increases to be provided to your tenants in writing. \u00a0Your notice must inform your tenants how much the new rental rate will be and when it will take effect. The amount of notice you must give depends on how much the rent will increase. In most states, you must give your tenant a written notice 30 days prior to an increase taking effect if the rent is increasing by 10 percent (or less) of rent charged at any time during the 12 months before the rent increase takes effect. \u00a0If you increase the rent by more than 10 percent, a landlord must give 60 days&#8217; advanced notice in writing.<\/p>\n<p>Another aspect of the 10 percent threshold applies to cumulative rent increases totaling 10 percent or more over a 12-month period starting after the first rent increase. \u00a0For example, on a month-to-month rental agreement, if a landlord raises a $1000\/mth. rent by $50, starting on October 1st; given that it is only a 5% increase only a 30 days notice is required. \u00a0But if the same landlord wants to increase the rent again by another $75 on May 1st only 6 months later, the landlord would be required to give 60-days notice before the second rent increase because the $75 raise would constitute a cumulative rent increase amount of $125, or 12.5 percent of the original rent amount.<\/p>\n<p>Every state is different, and you should always check with your state and local landlord-tenant laws to make sure you are compliant in your region.<\/p>\n<h3>How much to increase rent by?<\/h3>\n<p>In most cases, a landlord has the legal right to ask whatever price he wants for a rental property.<\/p>\n<p>Several factors affect the amount of rent acceptable to charge tenants living in your rental property. For landlords, rental payment amounts are a balance between wanting the highest possible rental income, maintaining a competitive price point and attracting the best tenants.<\/p>\n<p>In a competitive rental market, most tenants have the opportunity to choose from several different available properties, so setting an appropriate rent amount will help keep the unit occupied by qualified, responsible tenants.<\/p>\n<p>The right rent needs to be on par with comparable rental properties in the neighborhood. There are a few great online resources that allow anyone to compare rent prices based on unit size and location. \u00a0Websites like <a href=\"https:\/\/www.rentometer.com\/\">Rentometer.com<\/a> are a good starting point for assisting landlords with determining comparable rents in their property\u2019s neighborhood.<\/p>\n<p>In some cities, <a href=\"http:\/\/www.nakedapartments.com\/guides\/nyc\/renting-in-new-york-city\/rent-regulation\">rent control or rent stabilization laws<\/a> limit a property owner\u2019s ability to raise rent prices above a certain amount, with the intention of preventing average city-dwellers from getting priced out of the rental market.<\/p>\n<h3>How to Handle Backlash?<\/h3>\n<p>Once you\u2019ve announced your increase, be prepared to address negative feedback from your tenants with a legitimate justification for your action.\u00a0<i>Are you matching market prices? Do you offer new amenities? Are you updating the property?<\/i>\u00a0If you keep your tenants informed as to the reason behind a new, higher monthly rent, they will be more willing to adhere to your changes.<\/p>\n<p>Raising your rent prices might have more success if you offer the higher rate to new tenants, rather than current tenants. You might experience more pushback and higher tenant turnover if you suddenly increase your rent rates for tenants who are used to your prices.<\/p>\n<p>Assess the financial impact of what will happen if your tenants move. Your place might sit empty for a month while you try and find equally comparable tenants. You must decide if you would rather spend the time and money finding new, qualified tenants who are happy to pay your increased rent price or spend the time asking current residents to renew leases at their current rental rate.<\/p>\n<h3>Tenants Rights Regarding Rent Increases<\/h3>\n<p>Beyond required notices and when a landlord is allowed to increase rent, most states have laws protecting tenants from rent increases, as retaliation or discrimination are illegal. \u00a0For example, a landlord may not raise the rent on tenants of a certain race or familial status. And most states prohibit rent increases in retaliation to a negative experience with a tenant to punish the renter.<\/p>\n<h3>Something else to consider&#8230;<\/h3>\n<p>A good practice a landlord may follow, is building regular rent increases into the lease agreements. By raising rent by a small percentage each year, you will be able to consistently follow raising market trends, without burdening your tenants with a huge increase.<\/p>\n<p>Perhaps you feel comfortable with your current rent prices but what about 5 years from now? Say in 5 years, you re-evaluate your asking rent and discover you could easily ask $100 more per month on your property to match market trends.<\/p>\n<p>Imagine the difference on your tenants if you simply raise the monthly rent by $20 every year for five years, instead of them paying the same flat rate for 5 years, only to receive a notice that you are suddenly increasing the rent by $100!?<\/p>\n<p>In that first year, you will be generating only $240 more annually on that unit. \u00a0But by year two you will collect $480 extra. And by year five, at $100 more a month, your income will grow by $1200 annually from that one property. Given regular occupancy, over 5 years you will have earned an additional $3600* from that one property, and by slowly increasing your asking rent by only $20 a year you limit the negative impact on
