I mean, verifying their credit history, their criminal history, and running an eviction report. You need to gather as much data as you can to make a legal, qualified screening decision in order to find the most qualified rental applicant for your rental house.<\/p>\n\n\n\n<p>Qualified means someone who&#8217;s likely to pay their rent on time, follow property rules and maintain the property, and keep your neighborhood and property safe.<\/p>\n\n\n\n<p>My name is Kaycee Miller. Using the criminal background report is a way that you can make a legal screening criteria decision about a rental applicant.<\/p>\n\n\n\n<p>But it&#8217;s always super important to understand your legal responsibility in maintaining and upholding <a href=\"https:\/\/www.rentecdirect.com\/blog\/the-fair-housing-act-laws-for-landlords\/\">federal fair housing laws<\/a> and any state, local, countywide, federal regulations that are in place that help you make legal screening decisions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-criminal-background-reports-are-used-in-tenant-screening\"><strong>How Criminal Background Reports Are Used in Tenant Screening<\/strong><\/h2>\n\n\n\n<p>When it comes to criminal background, usually you can pull a criminal history report on a rental applicant to see if they have been convicted of any violent crimes that could make it so they might be a dangerous renter in your rental property.<\/p>\n\n\n\n<p>Now, I say lots of words like \u201c<strong>could be\u201d<\/strong> or \u201c<strong>might be\u201d<\/strong>, and you&#8217;re making decisions that are quantifiable based on data. You decision is also based on risk mitigation and evaluating the likelihood that a tenant might not be a good renter based on past convicted behavior.<\/p>\n\n\n\n<p>But again, all of this is determined by your state, local, federal laws, because <a href=\"https:\/\/www.zillow.com\/rental-manager\/limits-rental-applications-reports\/\" target=\"_blank\" rel=\"noreferrer noopener\">some jurisdictions have laws where you can&#8217;t even use criminal history <\/a>until your tenant has passed all the other screening criteria or you can&#8217;t even use criminal records at all.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.seattle.gov\/civilrights\/housing-rights\/criminal-history-protections\" target=\"_blank\" rel=\"noreferrer noopener\">Like in Seattle<\/a>, there is a law in place where you can&#8217;t even use criminal records for tenant screening. Usually that has to do with preventing discrimination and giving renters a fair chance at housing.<\/p>\n\n\n\n<p>But in other cases, when you can <a href=\"https:\/\/www.mysmartmove.com\/blog\/how-risky-tenant-screening-can-ruin-your-rental-business\" target=\"_blank\" rel=\"noreferrer noopener\">legally look at someone&#8217;s criminal record<\/a>, what you&#8217;re trying to determine is looking back at past criminal convictions of crimes that might prove dangerous to your property or the surrounding neighborhood or other tenants in your property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-criminal-records-are-tracked\"><strong>How Criminal Records Are Tracked<\/strong><\/h2>\n\n\n\n<p>Now, using criminal records, there&#8217;s some important things to consider. Criminal records are recorded based on someone&#8217;s <strong>name, date of birth, and property address<\/strong>.<\/p>\n\n\n\n<p>So if you think of someone&#8217;s name, there might be lots of people by the same name out there on a national criminal database.<\/p>\n\n\n\n<p>But you&#8217;re then trying to narrow it down by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do they have the same name as your rental applicant?<\/li>\n\n\n\n<li>Do they have the same birthday?<\/li>\n\n\n\n<li>Does the address match anything on their rental history that they provided on your rental application?<\/li>\n<\/ul>\n\n\n\n<p>The discrepancy on what&#8217;s reported on a nationwide criminal history has to do with how a local jurisdiction reports criminal crimes to a nationwide database.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-choosing-the-right-tenant-screening-vendor\"><strong>Choosing the Right Tenant Screening Vendor<\/strong><\/h2>\n\n\n\n<p>So when you&#8217;re <a href=\"https:\/\/www.rentecdirect.com\/blog\/tenant-screening-reports-created-equal\/\" target=\"_blank\" rel=\"noreferrer noopener\">determining which tenant screening vendor<\/a> to use, you want to find one that has a really robust criminal database and is working with a tenant screening provider that can really show lots of nationwide criminal history, but then also allow you to narrow down to a <strong>state, city, or county level<\/strong> to really determine the criminal history of a rental applicant.<\/p>\n\n\n\n<p>In some cases, different counties or cities don&#8217;t even have digital records of criminal history, which is why they&#8217;re not showing up in the national database.<\/p>\n\n\n\n<p>If you pull a criminal record report on a tenant in a specific county based on property address, that actually might require someone physically going down to a courthouse and manually going through paper copies of criminal records to find one that could match a rental applicant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-different-levels-of-criminal-history-searches\"><strong>Different Levels of Criminal History Searches<\/strong><\/h2>\n\n\n\n<p>When you are pulling a tenant screening report, that&#8217;s why there might be different levels of the types of searches that you can do.<\/p>\n\n\n\n<p>You need to really determine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is a nationwide criminal database going to be enough?<\/li>\n\n\n\n<li>Or do you really want to go down to that <strong>county level<\/strong> and <strong>specific local level<\/strong> to find out whether or not you are going to approve this rental applicant?<\/li>\n<\/ul>\n\n\n\n<p>That&#8217;s why <strong>criminal history is just one of those tenant screening data points<\/strong> that you might use for making a housing decision.
